Motorcycle Clipped By A Car
The client suffered a serious foot injury requiring surgery when his motorcycle was clipped by a car while on the interstate. Somehow, he managed to keep the bike upright and controlled his stop. X-rays initially were negative, but a second series showed fractures. Remarkably, he made a full recovery in seven months and returned to normal activities. The insurer questioned liability since it was unclear which lane the impact really occurred.
They also questioned the nature and extent of his injuries since he suffered from a prior injury to this same foot which put him on disability. That injury occurred while he was in the armed services and during active combat. We were able to point out that the impact did indeed occur in his travel lane based on the trajectory of his motorcycle post impact, and argued the differences in his injury and argued these were new injuries. The insurer eventually settled for $715,000.

Injury From Motorcycle Accident
Client was injured on his motorcycle when the defendant pulled from a driveway and cut him off and caused an impact. Client had right shoulder injuries, but he was without health insurance. In addition, he was operating his father’s motorcycle which was a 1995 H-D but was customized and had a new engine put in the prior season. We worked with him to get the full compensation for the motorcycle buy pushing to get all of the receipts, photos and serial numbers for the add-on parts.
Since he was without health insurance, we discovered he had some medical payments coverage, an option coverage for motorcyclists, and used this to get him into some initial care while not paying his $10K+ initial hospital bill. This allowed him to get some care until his health insurance kicked in, and once it did, he underwent surgery. This also prevented him from having gaps in treatment so that we could show the surgery was indeed needed due to the accident.
Our client required surgery as a result of the accident. The case settled for $400K, and we were able to negotiate drastic reductions to his medical bills putting substantially more money in his pocket.
