Motorcycle Clipped By A Car
The client suffered a serious foot injury requiring surgery when his motorcycle was clipped by a car while on the interstate. Somehow, he managed to keep the bike upright and controlled his stop. X-rays initially were negative, but a second series showed fractures. Remarkably, he made a full recovery in seven months and returned to normal activities. The insurer questioned liability since it was unclear which lane the impact really occurred.
They also questioned the nature and extent of his injuries since he suffered from a prior injury to this same foot which put him on disability. That injury occurred while he was in the armed services and during active combat.
